On the N63 engine, the individual vanes of the VANOS unit are no longer individual parts but rather they have been further developed to form an oscillating rotor (as on the N52 engine). The torsion spring integrated in the N62 VANOS unit is now designed as a coil spring accommodated on the front of the N63 VANOS unit protected by a plastic cover.

The "hot v layout" is now the configuration in most if not all of the high end V8s(Porsche, Audi, BMW, Mercedes, Ferrari and more) and is not reserved only for V8s. The current 4.4L TTV8 is a masterpiece, owners love them. Stick with the most current version.

If not, that should be the first step (all N63 engines since 2009 are eligible) - injectors will be replaced as part of the campaign, if they're older than index 11. If that's the case, then you have a good case for BMW to foot the bill, as the condition was brought about due to faulty injectors.
